Unfortunately, even though there are many potential plaintiffs, that does not mean this kind of lawsuit will meet the requirements needed to be certified as a class action. Google "Class action cerification requirements", which also vary by jurisdiction, state and federal.

WHY would a medical insurer not only approve for an out of network surgeon to do the kind of surgery (mastectomy) that so many in network surgeons are experienced at doing and WHY no limit to the amount that they will pay? We need an insurance company whistle blower since, yes, ultimately impacts premiums everyone pays.

This woman has no morals whatsoever. Isn't she the one who operates on women who are too overweight for surgery? I remember reading about a surgeon who removed the breasts of an overweight woman who then had serious problems healing as I think the stitches kept coming apart. The surgeon eventually ended up ghosting her. That sounds just like Gallagher. The victim had a huge ordeal and shared the horrors.

Regarding the state fund that paid out a large portion of this settlement, I wonder where the money 💰 comes from to make up that fund?

It comes from hospitals, nursing homes and other facilities mandated to contribute.

Why the $1 in the $375K case? Why in hell would an insurer agree to $200K for a mastectomy, even a fancy-pants "gender affirming" version? They must have a "usual cost" guidebook, yes?

I would hope so. My working theory is either incompetence by insurer, kickback to criminal working for insurer, or regulatory sabotage.

Thanks for reporting on this, Exulansic. We have all been waiting for an avalanche of lawsuits in a hope this might stop being covered by insurance companies and therefore bring the whole edifice down. But it never seems to happen. I’m in the UK, so perhaps just unaware of what’s going on in the US. So, it seems that, even though the surgeons can’t get malpractice insurance, they are making so much money that it does not matter. Is there no sign that private medical insurance companies are starting to withhold funding for these surgeries given the evidence from Cass? And can’t the surgeons be censured by the medical regulator at all ?

It's a drop in the ocean to this butcher and no where near enough for the harm she has done. She should be struck off medical registers GLOBALLY, and jailed. No amount of money can compensate for what she has done
